Oklahoma prosecutor clears trooper in shooting

Cleveland County’s top prosecutor has cleared an Oklahoma Highway Patrol trooper who shot and wounded a teenager while responding to a road rage incident on Interstate 35 in Norman.

District Attorney Greg Mashburn said Thursday that no action will be taken against 37-year-old Trooper Joe Kimmons following the Sept. 22 incident.

Mashburn says in a letter to Highway Patrol Chief Kerry Pettingill that evidence indicates the use of force by Kimmons “was justified and appropriate under the law.”

The letter says the unnamed teenager was one of three people involved in a violent altercation with a woman whose car they damaged. It says the teen who was shot resisted arrest and tried to grab the pistol of an Oklahoma game warden who had also responded to the incident.
