ADA - Joshua D. Hamburger, 26, Roff, was given a five year suspended sentence Wednesday in district court for the rape in the second degree of a 16 year old girl. Hamburger and the girl had a baby as a result of their relationship. Hamburger’s sentence was in part influenced by the teen’s father who told Chris Ross, assistant district attorney “It would do no good for him to serve time; he needs to support his child.”

Hamburger pleaded no contest and agreed to the conditions recommended by Ross. Hamburger was ordered to report to the probation officer before 5 p.m. April 28, to pay $1055.90 court costs, be subjected to random urinalysis testing and comply with paternity procedures. Judge Landrith stressed to Hamburger his failure to pay child support would result in his serving time in prison.
