A Seminole man who raped a woman in July 2010 was sentenced Thursday. Cooky Carbitcher, 44, was sentenced to 34 years for first-degree rape, 34 years for first-degree rape by instrumentation and five years for failure to register as a sex offender. All sentences will run concurrent (together).
Carbitcher was convicted in Pontotoc County District Court June 7 after a non-jury trial.
He was charged in August 2010 after a victim accused him of raping her at a residence south of Ada in July 2010.
The victim was staying at the residence after running away from home, according to a report filed by Pontotoc County Sheriff’s Deputy Kenny Heck.
“(The victim) disclosed she had been drugged, then raped by (Carbitcher) at a house off Kerr Lab Road near the city of Ada,” Heck said.
Assistant District Attorney Jim Tillison said Carbitcher must serve 85 percent of 34 years before he is eligible for parole.
