Local man arrested, released; Incident involving convicted sex offender under investigation

Police say they are going back to work on a case involving a convicted sex offender they arrested last week.

The man was accused of picking up four teenage girls at Glenwood Skate Park and taking them to Rosedale Cemetery to do drugs.

However, Billy Morgan Beam, 43, who lives just outside Ada's city limits, denied seeing the girls until later that night, when he stopped to assist them on South Oak Avenue.  

That’s also where two witnesses saw one girl who seemed to be having trouble and was sick.

Beam paid $196 for a series of court fees in Pontotoc County District Court and pleaded guilty to contributing to the delinquency of a minor, a misdemeanor.

He was released from custody just before 9 a.m. Thursday.

Pontotoc County District Attorney Chris Ross said his office could not present felony charges for loitering at a public place because, by legal definition in the Oklahoma statutes, Beam wasn’t loitering.

The statute that creates a safety zone for playgrounds and prohibits a convicted sex offender from loitering in certain places where children are known to be is specific on what constitutes loitering, Ross said.

 Nor could the D.A. present a felony case on drug charges because of testimony from at least one of the four girls involved.

 The same girl who got sick told police she is related to Beam and called him to come to Glenwood Skate Park, pick up the girls and take them to another girl’s house. 

“That’s not loitering,” Ross said. “The problem with this case is, loitering is if someone is hanging around a park or school with no reason. If someone is calling you to pick them up, and you pick them up, it’s not loitering."

  Ross also said no evidence was presented on the type of drugs allegedly used in the incident.

 “We’re doing some follow up on this investigation, and we will be giving those findings to the D.A.," Assistant Police Chief Jeff Crosby said.
